Terms and Conditions

The user (hereinafter referred to as "User")registering in the smartphone application "Emobility Solutions" (hereinafter referred to as "Application") ofEmobility Solutions Ltd. (hereinafter referred to as "Service Provider")and using the ad hoc download available from the browser (hereinafter referred to as "Ad hoc User" ) accepts the following terms and conditions and acknowledges them as binding.
If the User does not agree to be bound
by these Terms and Conditions ("T&Cs"), theApplication, the browser-based ad hoc download and the related download services may not be used or accessed.

1. Introductory provisions

The provisions of these GTC have been drafted taking into account the following:

  • the provisions of Government Decree 243/2019 (X.22.) on certain issues of electromobility services;
  • Article 2(1)(f) and (g) of Act I of 1988 on Road Traffic;
  • Act LXXXVI of 2007 on Electricity (hereinafter referred to as "Act LXXXVI of 2007 on Electricity");
  • Government Decree No 273/2007 (X. 19.) on the implementation of certain provisions of Act LXXXVI of 2007 on Electricity (hereinafter: Vet.vhr.).

The Service Provider reserves the right to unilaterally modify these GTC. The Service Provider shall notify the User electronically of the modification within 30 days prior to the effective date. The Service Provider shall make the fact and content of the amendment available to the User on its website and through the Application. If the User uses the Service after the entry into force of the amendment, the User shall accept the amended provisions at the first login via the Application. After downloading the Application and registering (which includes acceptance of the GTC), the User enters into a case-by-case contract with the Service Provider by starting the download or payment process. The contract shall be concluded between absentee users without a separate written contract, by electronically charging at a filling point for the filling of a vehicle.

The language of the contract is Hungarian.

2. Service provider details

The website cpm.esols.eu, where the ad hoc loading available from the browser can be done, and the owner and operator of the Application is the Service Provider.

Customer service

The service provider shall display the contact details of the online and telephone customer service in a clearly visible manner on all charging equipment. Customer support is directly accessible from the App via a call button. The User can report malfunctions or damage to the charging equipment via the customer service. The Customer Service is available 24 hours a day, 7 days a week to receive reports from Users at the following contact details:

3. Description of the service

3.1 These T&Cs apply only to the cpm.esols.eu website, the Application and the electric vehicle charging facilities operated by the Service Provider or its roaming partners. By accepting these T&C and registering in the Application, and subject to the other applicable provisions of these T&C, the User may use the following services (hereinafter referred to as the "Service"):

  • Information services of the application (e.g. charging map, payment and billing data, user's vehicle data, previous charging data, summary invoices issued);
  • charging (hereinafter "Charging")at electric vehicle (hereinafter "EV")charging facilities operated by the Service Provider or by the Service Provider's contracted partners under roaming agreements and opened to traffic by Users; payment and billing services;
  • Request, assign, activate, disable a physical (RFID) customer key (hereinafter referred to as RFID customer key).

3.2 The list of chargers operated by the Service Provider or its roaming partners is constantly updated on the map and chargers list of the Application and the Website.

3.3 The Service Provider's name will be displayed on the chargers covered by the Service to facilitate their identification, and each charger will have an instruction manual and/or a web link to the instruction manual, as well as a unique QR code and IDACS identifier for the charger.

3.4 The Service shall be available at least 90% of the opening hours of the physical availability of the relevant electrical charging equipment, except in the case of force majeure.

3.5 The Service, or any part of the Service, may be provided by the Service Provider or one of its commercial partners. The Service, or any part thereof, may be provided by the Service Provider or its commercial partner in its own name and for its own benefit, or in its own name and for the benefit of a third party.

3.6. The Service Provider reserves the right to change the Technical Terms and Conditions if, in the opinion of the Service Provider, this is necessary due to technical progress or in the interest of the Service or the security of the Service.

4. Rules for using the service

4.1 The User can use the electric charging service on the Application or on the website as an occasional user or as a registered user.

4.2 The Service Provider is entitled to temporarily suspend the provision of the service in order to carry out the necessary troubleshooting and maintenance work.

4.3 The Service Provider shall have the right to refuse to provide the services to the User if required by law or an official/judicial decision, or if the User uses the service in a manner that is contrary to the GTC, in any other unlawful manner or for a purpose for which it is not intended. In the event of refusal to provide the Service, the Parties shall settle the amount of the consideration for the Service provided up to the date of refusal.

4.4 Only electric vehicles may stop for charging at the charging point. The service provider shall be entitled to have the vehicle unauthorisedly occupying the charging point removed and to recover the costs of removal and all related costs from the owner/operator of the vehicle.

5. Charging service for Occasional Users

Occasional Charging: occasional charging on EV Charging Equipment operated by the Service Provider and opened for traffic by any User, without registration in the Application or on the Website.

If the Occasional User decides to make use of an occasional charge (hereinafter "Occasional Charge"), he/she can do so by scanning the QR code on each charging device and by accessing the cpm.esols.eu website/application.

The charging process is possible after reading and accepting the GTC on the website/application and providing the necessary data for payment and invoicing. Once the data has been provided and the charging station connector has been selected, the amount corresponding to the charge initiated will be blocked on the User's credit card. If the blocking is successful, the top-up is automatically started.

At any time, the occasional user can stop the charging process by dragging the "Slide to stop" slider or by clicking on the stop link sent to the email address provided, or the energy transfer will be interrupted when the device is fully charged. Once charging is complete, the blocked amount will be released and only the actual charge for the charge will be deducted. In the case of charging in excess of the blocked amount, a new payment link will be sent to the e-mail address provided by the Occasional User once the charging process has been completed. We are entitled to send further payment reminders to the e-mail address provided until the outstanding debt has been settled.

The User will receive an invoice for the charge to the e-mail address provided.

6. Use of top-up service for Registered users

6.1. Use of the top-up service via the App

The User can download the Application required to use the service from the Google Play or Apple Store, depending on the operating system of the mobile device (iOS, Android). To start the Vehicle Download, the User must create a personal user account in the Application. Registration is possible by registering a billing address and registering a "Bank Card". Upon registration, the User must accept the Terms and Conditions and the Privacy Policy after reading them. Registration is free of charge. Confirmation of registration will be sent by e-mail. If the User does not wish to accept the amendments to the GTC, the further use of the user account will be cancelled by the Service Provider.

The Service Provider will endeavour to provide the User with a continuous and uninterrupted service, but cannot guarantee that the Service will always be available, continuous, timely or error-free.

6.2. Initiating a top-up using an RFID client key

"RFID Customer Key"means the identification device that allows the User to be identified remotely and, where available, to receive payment services at electric vehicle charging stations without using the Application online.
The steps to apply for an RFID Customer Key:

  • The registered User can request an RFID client key by sending an e-mail to helpdesk@esols.eu and providing the following information: User's name; e-mail address registered in the application; mobile phone number registered in the application; billing address; mailing address.
  • The Service Provider will then send the User an electronic invoice for the RFID key, which the User will pay by bank transfer. The Service Provider will send the inactive RFID key to the mailing address provided by the User.
  • Upon receipt, the User will send an email to helpdesk@esols.eu with his/her name, email address and mobile phone number to activate the RFID key. The RFID client key will then be assigned to the User's account and the client key will be activated to enable the recharge. If the User has more than one electronic payment instrument and billing address registered in the application, the User must indicate in the e-mail which of these will be assigned to the RFID Client Key.

If the User no longer wishes to use the RFID Client Key in the future, he/she may request its deactivation by sending an e-mail to helpdesk@esols.eu.

The initial application fee for the RFID customer key is HUF 5000 and is the property of the User. The
Service Provider is entitled to unilaterally determine or change the fee for sending the additional RFID customer key. The current fee for sending a replacement RFID client key is HUF 5000.

The RFID client key is paid in advance by bank transfer on the basis of a fee request.

7. Payment and billing

The Service Provider shall provide payment services to the User within the framework of the Service through various banks, financial service providers, payment system operators, financial institutions and other financial intermediaries (hereinafter referred to as "Financial Service Providers") that are independent of the Service Provider but have contractual relations with the Service Provider. Through these payment services, the User can initiate payments to the Service Provider in respect of the Services used by the User. In order to use these payment services, the User must also accept a separate contract with the relevant Financial Service Provider, as defined by the relevant Financial Service Provider, separate from these GTC.

The services provided by the Financial Service Provider are provided solely for the convenience of the User and shall not be deemed to be represented, approved or endorsed by the Financial Service Provider. The User may use the services provided by the Financial Service Provider solely at its sole discretion and at its own risk. The User acknowledges that the use of the services provided by the Financial Service Provider is not covered by these GTC. In the event that the User uses such services, it is the User's responsibility to review, understand and accept the terms and conditions of use and policies of the service. The Service Provider assumes no responsibility for the use of the services provided by the Financial Service Provider. The use of the services provided by the Financial Service Provider is not covered by the Service Provider's Privacy Statement. The use of the services provided by the Financial Service Provider, including the services available through links to the website or platform operated by the Financial Service Provider on the Service Provider's website or Application, is subject to the terms of use and privacy statement of the respective service.

7.1. Payment by credit card via the App (as described in point 6) and payment by credit card for occasional top-ups (as described in point 5)

During the process, the Service Provider directs the User to the secure payment page of OTP Mobil SimplePay ("OTP SimplePay"), the payment is made directly on the page operated by OTP Mobil Szolgáltató Kft. ("OTP Mobil Kft."), which operates according to the rules and security standards of international card companies. The service provided by OTP Mobil Kft. is not subject to the present GTC, the User is obliged to review and accept the terms and conditions of use of the service in order to use the payment service. The Service Provider does not assume any liability for the use of the services provided by OTP Mobil Kft.

The operator of OTP SimplePay, OTP Mobil Kft., acts independently with regard to the data provided on the OTP SimplePay site. Only OTP Mobil Kft. has access to the personal data provided on the OTP SimplePay website.

By accepting the GTC, the User acknowledges that the personal data stored by Emobility Solution Kft. (1025 Budapest, Felső Zöldmáli út 3/B.) in the cpm.esols.eu user database will be transferred to OTP Mobil Kft. as the data processor. The data transmitted by the controller are the following: user name, billing address, e-mail address and telephone number. The nature and purpose of the data processing activities carried out by the data processor can be found in the SimplePay Data Processing Information Notice, at the following link: http://simplepay.hu/vasarlo-aff

In the case of payment by credit card via the Mobile Application, if the User has successfully made a payment by credit card, the Service Provider will send an electronic invoice to the User's e-mail address, which will include the unit price of the invoice, the amount of electricity (kWh) used to charge the Vehicle's battery and the amount of the electromobility service used by the User for each minute started, as well as the statutory charges.

7.2. Basis of calculation:amount of electricity charged for power (kWh)

7.3.Sending of invoices: the User will receive a monthly (on the 1st of the month following the month in question) electronic summary invoice to his/her registered e-mail address for the Spending made during the given period.

7.4.Billing complaints: if the User encounters any technical problems during the payment and/or billing process related to the Service, he/she may report them to the Service Provider without delay, but preferably within 5 days at the latest, in order to remedy the problem and to identify the circumstances as efficiently as possible.

8. General provisions

8.1 By registering online, the User accepts that the Service Provider provides the services specified in these GTC online.

8.2 The Service Provider reserves the right to refuse registration without giving any specific reason, or to withdraw it temporarily or permanently at any time, in particular in the following cases:

  • providing false or incomplete information during registration;
  • a previously registered User whose contract has been terminated by the Service Provider for breach of contract.

8.3 The User is obliged to ensure the functioning (maintenance) of the online contact details (e-mail address) registered by him/her. The Service Provider shall not be liable for any damage resulting from the provision of incorrect or non-functional online contact details (e-mail address), and the User shall be liable for any obligations towards the Service Provider.

8.4.The Service Provider informs and reminds the User to change his password regularly and not to give it to anyone or store it in a place accessible to others. The safe storage of the password and the provision of the current online contact information (e-mail address) suitable for notifying the User is mandatory even when using the Application and is an event in the User's interest, the Service Provider shall not be liable for any damages resulting from the failure to do so, and the failure to do so shall not release the User from the performance of his obligations towards the Service Provider.

8.5. tick the box next to the text "I understand and accept the Privacy Policy" : the User declares that he/she understands and accepts the Privacy Policy of the Service Provider's Application.

8.6. tick the box next to the text "I understand and accept the General Terms and Conditions" : the User declares that he/she understands and accepts the General Terms and Conditions for the Service Provider's Application and that he/she has made the declarations contained therein.

8.7. tick the box next to the text "I understand and accept the Terms of Use" : the User declares that he/she understands and accepts the terms of use of the Service Provider's Application.

8.8. The User is obliged to modify his/her data in the Application in case of any change in his/her data.

8.9 Forgotten password The User may request a new password before logging into the Application by using the "Forgotten password" function. After entering the previously registered e-mail address, the system sends a message to the e-mail address provided at registration, which contains a button (link) directing to a website or interface. By clicking on this button, the User can enter a new password. In the event of an unsuccessful password change, the User can contact the Service Provider's Customer Service at helpdesk@esols.eu for assistance.

8.10. Profile data

The User can make the following settings/modifications in the Application under the menu item Billing data and Request RFID customer key:

  • Name
  • mailing address.
  • billing address

8.11. The User, whether or not he/she has requested an RFID client key, shall provide the details of the Bank Card with which he/she can make a payment when registering in the Application.

8.12. Password modification

If the User wishes to change his/her password, he/she can enter a new password in the Application. The system will give an automatic confirmation of a successful password change. In case of unsuccessful password change, the User may contact the Service Provider's Customer Service for assistance.

8.13. During the registration process, the User is obliged to provide the real data that can be linked to him/her. The Service Provider, if it becomes aware that the data provided by the User (also) contains elements that are not real, is entitled to restrict access to the Application in whole or in part or to exclude the User from using the Application.

9. Information technology and technical conditions for the use of vehicle charging stations, Charging on demand

9.1. IT requirements

To start filling:

  • In the case of occasional charging, it is possible by scanning the QR code on the charger or by opening the website cpm.esols.eu from a web browser, which requires a smartphone and an internet connection at the same time, or
  • after identification of the User, which requires a smartphone, the App, valid registration and an internet connection at the same time, or
  • without an internet connection and without using your smartphone, by touching the registered RFID customer key to the charger.

9.2. Technical conditions of the vehicle

9.2.1 The Charge can be used by a plug-in or fully electric vehicle capable of electric propulsion. The User must have a technically suitable charging cable. The charging pole shall have one or two Type 2 connectors that can be used independently of each other. The charging mode used is Mode 3. The
CCS Combo or CHAdeMO connection
used on charging poles with a fixed cable. The charging mode used is Mode 4.

9.2.2.2 The User shall ensure that the technical condition of the vehicle is satisfactory, in particular with regard to the protection of life and property.

9.2.3 The maximum charging power per connection is: 22 kW for fast chargers and 50 kW for rapid chargers. The actual charging power depends on the type of vehicle connected and the type of charging cable used and the temperature and charge of the battery.

9.2.4 The User must ensure that the electric vehicle complies with the relevant charging standards (IEC 62196, IEC 61851), that the charging cable is certified by the manufacturer and that it is undamaged. The User is liable for any damage caused by a defective charging cable.

9.2.5 The User must also check that the Vehicle's Charge starts on the correct side and with the correct lettering and that it is completed correctly. The start and completion of the charge is always determined by the communication between the car and the charger, which may take a few seconds after pressing the start/start or stop/stop button.

9.2.6 To start charging, the User must check the information on the charger's display or on the description otherwise displayed on the charger. A Charge initiated with an RFID Customer Key will be initiated when the User has connected the vehicle to the charging station in accordance with the instructions following RFID identification. The User must ensure that the vehicle is compatible with the charging stations and that it can be charged at the station. The fee for the Charge initiated with the RFID Customer Key, if any, shall be charged to the User's debit or credit card registered for the Service upon completion of the Charge, as set out in these GTC.

**10. User's obligations **

10.1 The User is obliged to keep his/her registration password confidential and to keep it secret. The User shall immediately inform the Service Provider if he suspects that a third party has gained access to or knowledge of his password.

10.2.The User shall immediately notify the Service Provider of the loss or damage of the RFID client key, and may request the blocking of the RFID client key and the sending of a new RFID client key to the User. The Service Provider shall not be liable for any unauthorized person's use of the PIN key.

10.3 Parking at the filling station is subject to the applicable traffic and private or public road use regulations and rules. If the charging point is located in an area subject to parking fees under local regulations, for which no exemption for electric vehicles is allowed by local ordinances, the User shall pay the parking fee directly to the parking company. The Service Provider shall not be liable for any failure to do so.

10.4 The IT content of the Service is protected by copyright, trademark and/or other intellectual property rights. The Service Provider shall be the owner of all personal and property copyrights in the Application as a work of authorship in the form of computer programs. By accepting these GTC, the Service Provider authorises the User to make non-exclusive, limited use of the Application. The User shall be entitled to use the Service only to the minimum extent necessary to enforce its rights and obligations under these GTC. In the event of unlawful use of the Program, the Service Provider shall be entitled to claim damages and to initiate the appropriate proceedings to enforce the civil and criminal law consequences provided for in Act LXXVI of 1999 on Copyright.

11. Obligations of the service provider

The Service Provider shall display the User's Load transactions in near real time in the User's user account, which the Service Provider shall make available to the registered User in the Application. Charging transaction reports for each period can be viewed at any time.

The Service Provider shall not be liable for any damages resulting from the User's improper use of the Application, the Service or the tools necessary for their use, or from the User's failure to exercise due care in selecting the appropriate safe environment in which to use the Services. The Service Provider shall not be liable for any damages resulting from viruses or other similar infections of the User's computer system (including any smartphone).

The Service Provider shall not be liable for the legality of the activity carried out by the Financial Service Provider or any third party in the course of providing the service and for the performance of any contract or non-contractual relationship between the User, the Financial Service Provider and any other third party. The Financial Service Provider or any other third party shall be solely responsible for compliance with the law and other rules and standards applicable to its activities, obtaining the necessary permits and notifications from the authorities.

The Service Provider shall not be liable for any damage caused by a cause beyond the Service Provider's control or for any cause beyond the Service Provider's control, in particular for any failure of telecommunication lines, Internet connection, data transmission systems or postal services.

The Service Provider shall not be liable for any damage caused by a cause which the Service Provider is unable to prevent or influence, in particular, by force majeure, by the order of a national or foreign authority or by the disruption of the Service Provider's operations, and the Service Provider shall not be liable for any damage caused by such cause, if the Service Provider temporarily suspends or limits the Application, the Service or the access to or provision of the Service.

The Service Provider shall not be liable for any damage suffered by the User as a result of any error or omission by the Financial Service Provider or any third party in the provision or performance of the Service. In the event of any dispute between the User and the Financial Service Provider or any third party, the User's liability or other obligation to the Service Provider shall not be affected by such dispute or counterclaim or right of set-off, which right the User may exercise only against the Financial Service Provider or a third party.

The Service Provider shall not be liable for any events, circumstances, damages or other consequences caused by:

  • the fault of the User;
  • the failure or inability of the User's mobile device to use the Application;
  • a fault in the operating system of the User's mobile device or in the communication connection used by the User;
  • improper use of the Application or use that otherwise violates these TOS;
  • the non-receipt by the User's mail system of automatic (informative) system messages that can be proven to have been sent by the Application.

The Service Provider does not assume any responsibility for the safe storage of the User's password or for any damage resulting from this.

In addition to the foregoing, the Service Provider shall have no other warranties or other obligations for the accuracy, reliability, operation, completeness, fitness for a particular purpose or purposefulness, suitability, or lack thereof, or for any direct or indirect damages or other legal consequences arising out of or resulting from the use of the Application. Furthermore, the Service Provider shall not be liable for any errors and their consequences arising from causes beyond its control (such as technical failures or power failures in the Internet network).

By accepting these GTC, the parties agree to be bound by the provisions of the Civil Code. 6:152, the Service Provider shall be liable for damages caused to the User in connection with the use of the cpm.esols.eu website and the Application, except for damages caused intentionally, or to human life, bodily injury or health, up to the amount of the consideration for the Service affected by the event. The Parties further agree that the Service Provider's liability shall be limited to damages directly related to the activity specified in the Contract, and shall not include indirect, unforeseeable, consequential damages or damages arising from the use of software provided by third parties.

12. Charges for the service

The current tariffs for the use of the chargers operated by the Service Provider are available on the Service Provider's website and in the Application. The Service Provider reserves the right to unilaterally modify the fees for the Service at any time, after prior notification of the Users via the Service Provider's website or the Application. It is the User's obligation to check the applicable and valid tariffs at the time of the start of the Charge.

13. Cancellation by the User

13.1 These GTC may be terminated by the User at any time, with immediate effect, upon cancellation of the registration. The User shall pay the fees for the Services for which a fee has already been charged at the latest upon cancellation of the registration.

13.2 The User using an RFID client key may, at his/her option, keep the RFID client key or return it to the Service Provider for destruction or recycling.

13.3 At the same time as the registration is deleted, the User's profile in the Application is automatically deleted. The Service Provider shall be entitled to store the receipts and invoices of already completed Filling transactions until the expiry of the general limitation period.

14. Termination by the Service Provider

The Service Provider shall be entitled to terminate this Agreement with immediate effect, subject to the obligation to state reasons, if the User (i) fails to meet its payment obligations despite a request to do so or (ii) uses the Service in a manner that is contrary to this Agreement. The Service Provider may also terminate this Agreement if the Service Provider has reasonable grounds to suspect that the User is using the Service inappropriately.

The Service Provider may terminate this Agreement by giving one (1) month's notice, effective upon expiry of the existing subscription (if applicable).

The Service Provider is entitled to terminate the GTC with 10 days' notice if the User has been inactive for 12 months or has not logged into his User account or has not started a download. Prior notice of termination will be sent to the User by e-mail. If the User initiates a new transaction before the termination takes effect, his User Account will not be deleted and the GTC will remain in force between the Parties.

15. Processing of personal data, security

15.1.The Service Provider is entitled to store, process and use the personal data provided by the User during the Case-by-Case Download or during the registration in the mobile application or at any time thereafter, in connection with the Service, as specified in the Service Provider's Privacy Policy. The User is obliged to make all reasonable efforts to protect his/her personal data, in particular to protect the username, e-mail address and, in the case of both online platforms, the password, in order to use the services provided by the Service Provider. The User shall be liable for any event, activity or omission that occurs through the use of his/her username or password.

15.2 The standard SSL (Secure Socket Layer) technology provided by browsers is responsible for the security of the data connection between the mobile phone used by the User to connect to the Application and the Service Provider's server. The Application used by the User encrypts the User's data before sending it using SSL. In this way, they are transmitted to the Service Provider in encrypted form and cannot be interpreted by unauthorised persons.

15.3.By accepting these GTC, the User acknowledges that the personal data stored by Emobility Solutions Kft. (registered office: 1025 Budapest, Felső Zöldmáli út 3/B.) in the user database of https://www.cpm.esols.eu and the smartphone application "Emobility Solutions", as detailed below, will be transferred to Billingo Technologies Zrt. (1133 Budapest, Árbóc utca 6., 1st floor) as data processor. The scope of the data transmitted by the data processor: email address and billing data (name, permanent address, tax number in case of companies). The nature and purpose of the data processing activities performed by the data processor can be found in the billingo.hu Data Processing Information Notice, at the following link: https://www.billingo.hu/adatkezelesi-tajekoztato

15.4. Recurring payment by credit card (hereinafter referred to as "Recurring Payment") is a function of credit card acceptance provided by SimplePay operated by OTP Mobil Szolgáltató Kft., which means that the credit card data provided by the User (Customer) during the registration transaction can be used to initiate new payments in the future without having to provide the credit card data again. The so-called "case-by-case consent" type of recurring payment is subject to the User's (buyer's) case-by-case approval for each transaction, i.e., the User (buyer) must approve the transaction for all future payments. In all cases, the User (customer) will be notified of a successful payment through the same channels as a traditional credit card payment. In order to use Recurring Payments, by accepting this declaration, the User (Buyer) agrees that following a successful registration transaction, subsequent payments initiated by the User (Buyer) from his/her user account on https://www.cpm.esols.eu or in the smartphone application "Emobility Solutions" will be processed without the need to re-enter the credit card details.

Please note(!):bank card data is processed in accordance with the card company's rules. Neither the Service Provider nor SimplePay, operated by OTP Mobil Szolgáltató Kft., has access to the credit card data.

16. Complaint handling and investigation of the Service Provider's payment transaction

16.1. Internal dispute resolution procedure

The User may send complaints and comments regarding the service and payment of fees by sending an e-mail to helpdesk@esols.eu, by clicking on the "Customer Service" button in the application, by calling 06 1 7733386 or by post. The Service Provider shall immediately remedy the oral complaint, if it has the possibility to do so, otherwise it shall address it within 15 calendar days and send its substantive reply to the User within 30 calendar days at the latest.

Complaints received by e-mail will be answered and handled by the Service Provider within 24 hours if possible, but within 3 (three) working days at the latest. Complaints received by post shall be answered by the Service Provider within 3 (three) working days of receipt by telephone, if the complainant has provided a telephone number, or in writing by means of a reply letter.

If the User wishes to lodge a complaint, he/she may do so within the general limitation period from the date of the relevant purchase transaction. The complaint must describe precisely the reason for disputing the characteristics of the transaction.

Complaints about incorrect Charges will be handled and investigated by the Service Provider. If the Service Provider deems the complaint to be justified, the Service Provider shall reimburse the amount concerned to the User without delay. If the complaint is rejected, the Service Provider shall notify the User of the outcome of the investigation, stating the reasons.

16.2. Complaints handling offices

If the User does not agree with the answer to the complaint received, or if any consumer dispute between the Service Provider and the User is not resolved in negotiations with the Service Provider, the User may submit a complaint to the following offices.

16.3. Online dispute resolution platform

If the Service Provider is unable to resolve the problem to the User's satisfaction and the Service Provider's products or services have been purchased online:

The European Commission has set up an online dispute resolution platform (ODR platform) specifically to help consumers resident in the European Union to resolve their complaints if they cannot settle their dispute with a trader or service provider established in the European Union from whom they have bought a product or service online. You can lodge your complaint in any of the official languages of the European Union online via the ODR platform. The notification requires the Service Provider's e-mail address (helpdesk@esols.eu), the address of its website (cpm.esols.eu) and the address of its registered office (1025 Budapest, Felső Zöldmáli út 3/B).

17. Other provisions

17.1 The present contract is a written contract between the Service Provider and the User. The Service Provider shall record the present contract, and the present contract and any amendments thereto shall be available on the Service Provider's website. The official language of this contract is Hungarian. The present GTC may be amended unilaterally by the Service Provider. The Service Provider shall publish the amendment on its website 15 days prior to its entry into force. The Service Provider shall publish the current version of the GTC on its website.

17.2 The invalidity of any provision of these GTC shall not affect the validity and effect of the other provisions, and in the event of partial invalidity, the remainder of the contract shall remain in full force and effect.

17.3 In matters not regulated in these GTCs, the legislation of Hungary, in particular Act V of 2013 on the Civil Code, Act CXII of 2011 on the Right of Informational Self-Determination and Freedom of Information, and the legislation in force on vehicle charging, in particular Act I of 1988 on Road Transport and the provisions of Government Decree 243/2019 (X. 22.) on certain issues of electromobility services, shall apply.

By expressly accepting these Terms and Conditions through the Application and by using the electromobility service, the User acknowledges that he/she has read and understood these Terms and Conditions and accepts to be bound by its provisions.

CONDITIONS OF USE

The cpm.esols.eu website (hereinafter referred to as the "Website") and the application called "Emobility Solutions" available in the Apple App Store and Google Play store (hereinafter referred to as the "Application") are the exclusive property of Emobility Solutions Kft. (Headquarters: 1025 Budapest, Felső Zöldmáli út 3/B, Company Registration Number: 01-09-188526, "Owner"), and Emobility Solutions Kft. (Registered Office: 1025 Budapest, Felső Zöldmáli út 3/B., Company Registration Number: 01-09-188526 "Operator") is the operator of the Application.

This document contains the terms and conditions of use of the Website and the Application (the "Terms").

1. Introduction (Acceptance, modification and intellectual property rights of the Website/Application)

By using the Website and the Application, the user accepts and is bound by the Terms and the Privacy Policy, which forms an integral part of it.

The Owner reserves the right, at its sole discretion, to modify and/or revise the Terms at any time. Unless otherwise stated, any amendment shall take effect immediately upon becoming available. If the User continues to use the Website and the Application after the amendments have become available, the User accepts the amended Terms.

All graphic and textual elements on the Website and on the Application, in particular texts, sounds, trademarks, graphics, images, articles and all other material and creative works accessible on the Website and on the Application, are protected by copyright or other legal protection and are the property of the Owner. Copying, use, modification or making available to third parties, as well as any use of the contents and elements of the Website and the Application, in any way whatsoever, is only permitted with the prior written consent of the Owner.

The Owner is entitled to modify or delete the content of the Website and the Application or any element thereof at any time without prior notice.

The Operator provides the technical support necessary for the operation of the Application.

2. Rights and obligations of the user

Users must not engage in unlawful, misleading or dishonest conduct or use information for unlawful or prohibited purposes.

You may not violate these Terms or encourage others to do so.

The user must not perform any activity that restricts or hinders the operation of the Website/Application.

You may not post confidential, untrue or infringing information in your posts, images or otherwise, or engage in any activity that violates the rights, including intellectual property rights, of others. For example, a user may not upload a picture that shows the license plate number of another car or the face of another person.

In connection with your use of the Website and the Application, you agree not to interfere with, disrupt, attempt to interfere with, or disrupt the operation of the Website and the Application or networks connected to the Website and the Application. Any breach or attempt to breach the security of the Website in any way shall constitute an infringement of the law and shall be subject to the consequences thereof.

3. Rights, obligations and exclusions of liability of the Owner

The Owner excludes all liability for any illegal conduct of the User and for the legality, truthfulness, timeliness of the content uploaded by the User, in particular for any illegal and/or untrue comments and images uploaded by the User. If these or any of the user's activities infringe anyone's rights or cause damage to anyone, the user shall be fully liable for them and shall be liable to pay compensation for any damage caused.

Errors and mistakes cannot be completely excluded in the preparation of the Website and the content of the Application, and the Owner is not responsible for the correctness, accuracy or completeness of the information and materials on the Website and the Application, and shall not be liable for any direct or indirect damage, loss of profit or any additional costs or damages arising from the use of any incorrect, erroneous or incomplete content on the Website and the Application.

The Website and the Application contain numerous links to other websites created and operated by service providers independent of the Owner. The Owner has no control over and does not monitor the websites linked to the Website and the Application and the content available thereon, and is not responsible for the content or accuracy of such external sites and is not liable for any damages arising from the use of such websites. The user acknowledges that, after clicking on the external link, the Owner has no control or influence over the collection or processing of personal data or the activities of the website operators and, accordingly, is not responsible for them.

The Owner may remove any content or information that the user has shared on the Website/Application if the Owner considers that it violates these Terms of Use, the rights of another person or if required by law. The Owner may immediately refuse or terminate the use of the Website/Application (including account termination or suspension) if the user seriously or repeatedly violates these Terms of Use, if the user violates the rights, intellectual property rights of others, or if required by law. If the Owner takes action to remove the User's Content or suspend or terminate the User's account, the Owner will notify the User as necessary.

The Owner will make every effort to ensure the continuous and uninterrupted operation of the Website and the Application.

Customer support is available on the Website and in the App to answer questions about the operation and use of the App using the built-in messaging system. The Owner will answer any questions, suggest a solution to the problem and take the necessary development measures to troubleshoot the problem. The Owner may, at its discretion, change the type and nature of the support at any time.

4. Other provisions

Problems and suggested solutions received through the support can be added to the FAQ list and, after the removal of personal data, to the knowledge database. The user can contact support by clicking on the Send Feedback button within the Application or by emailing helpdesk@esols.eu.

If the User notices any errors on the Website/Application or if he/she notices any images or comments that are offensive, abusive, rude, violate another person's right to privacy or personal data, or violate any other law or do not comply with these Terms of Use, please report them to us at the contact details above.

In the event of a consumer dispute, a user who is a consumer may apply to the consumer protection authority, court or conciliation body competent for the place where he or she resides or is staying.
